LEGAL NOTICE

1. Purpose and general information

This Legal Notice governs access to and use of the website www.fundaciocoac.org (hereinafter, “the Website”), which Fundació COAC (hereinafter: “THE FOUNDATION”) makes available to users (hereinafter, the “User(s)”), in its capacity as owner and manager of the Website.

This Legal Notice governs access to and use of the Website. Notwithstanding the above, the use of spaces or services contained within the Website may be subject to other terms of use. In such cases, the relevant terms must also be complied with, and Users will be duly informed of them.

THE FOUNDATION reserves the right to supplement, amend or replace this Legal Notice at any time, as well as any other general or specific terms, it being understood that the mere publication of the changes on the Website shall have the effect of notification. We therefore ask the User to read the terms carefully each time they access the Website, and to refrain from using the Website if they do not agree with any of the terms set out.

2. Rights and obligations of the User

Access to the Website is the sole responsibility of Users, and implies accepting and being aware of the legal notices, conditions and terms of use in force at any given time. Users must read this Legal Notice carefully whenever they access the Website. The use of any of the services offered confers, from the outset, the status of User and shall be considered express, voluntary and unreserved acceptance of this Legal Notice.

To access the services of the Website, in respect of anything that is not free of charge or that imposes a series of obligations, the User must be of legal age and have the legal capacity and the necessary authority to enter into contracts.

Use of the services offered on the Website implies that the User has agreed to comply with the requirements of these services and the Legal Notice of the Website. Users who access the Website undertake to comply with this Legal Notice and any special instructions for use shown to them at any given time. Users who voluntarily fail to comply with any of the obligations set out shall be liable for all damages and losses caused to THE FOUNDATION as a result thereof.

3. Disclaimer of liability

THE FOUNDATION reserves the right to interrupt access to the Website, as well as the provision of any or all of the Services provided through it, at any time and without prior notice, whether for technical, security, monitoring or maintenance reasons, due to power supply failures, or for any other cause.

THE FOUNDATION is not responsible for decisions taken on the basis of the information provided on the Website, nor for any damages or losses suffered by the User arising from such information.

THE FOUNDATION is not responsible for any damages or losses of any kind suffered by the User arising from errors in connection to telecommunications networks that result in the suspension, cancellation or interruption of the Website Service, or arising from causes of force majeure.

4. Intellectual and industrial property

All content, trademarks, designs, logos, icons, software, trade names, domain names and any other sign or element capable of protection under intellectual or industrial property rights forming part of the Website are the property of THE FOUNDATION, in the public domain, or belong to third parties who have duly authorised their inclusion on the Website and who are named as authors or rights holders.

Under no circumstances shall it be understood that any licence is granted, or that any waiver, transfer, or total or partial assignment of these rights is made, nor shall any right be conferred — in particular, the right of exploitation, reproduction, distribution, transformation or public communication — over this content without the prior express written authorisation of THE FOUNDATION or the relevant third parties.

Any infringement of the intellectual or industrial property rights referred to in this section shall be prosecuted through the criminal and civil actions provided for under current legislation.

5. Linking policy

Users and, in general, any persons intending to establish a link between their website and THE FOUNDATION’s website must have the express authorisation of THE FOUNDATION and comply with the following conditions:

  • The link shall only permit access to the homepage of the Website, or to the specific point authorised by THE FOUNDATION.
  • No frame shall be created over THE FOUNDATION’s web pages.
  • No false, inaccurate or incorrect statements or indications shall be made about THE FOUNDATION, its organisation, team or programmes. It shall not be stated or implied that THE FOUNDATION has authorised the link, or that it has in any way supervised or endorsed the services offered or made available on the website on which the link is established, except for those forming part of the link itself.
  • The website on which the link is established shall not contain any trademark, trade name, establishment sign, name, logo, slogan or other distinctive signs belonging to THE FOUNDATION.
  • The website on which the link is established shall not contain unlawful information or content, content contrary to generally accepted morals and standards of good conduct or to public order, nor shall it contain content contrary to any third-party rights.
  • The establishment of the link shall not, under any circumstances, imply the existence of any relationship between THE FOUNDATION and the owner of the website on which it is established, nor acceptance or approval by THE FOUNDATION of its content or services.
  • Finally, the use of technical, logical or technological resources by means of which anyone, whether or not a User of the Website, could benefit — directly or indirectly, whether for profit or not — from the content of the Website, is prohibited.

6. Private area

Access to any private area of the Website is personal and non-transferable, and the User undertakes to ensure the confidentiality of their credentials.

7. Forums 

The User undertakes to use the existing forums and to make comments that are not contrary to the law, morals, generally accepted standards of good conduct and public order, and that do not affect the dignity of individuals.

THE FOUNDATION does not carry out prior monitoring of comments on the Forums; however, it reserves the right to cancel, at any time and without prior notice, the activity of any internet user or User on the Website who contravenes what is set out in this clause and Legal Notice.

THE FOUNDATION complies with all requirements established by current legislation on the protection of personal data, and all data under our responsibility has been processed in accordance with legal requirements. 10. Applicable law

This Legal Notice is governed by Spanish law. In cases where the applicable regulations allow the parties to submit to a particular jurisdiction, both parties, expressly waiving any other jurisdiction to which they might be entitled, submit to the Courts and Tribunals of the city of Barcelona (Spain).
